GENERAL PROVISIONS

1.1. The BUYER acknowledges electronically the basic characteristics of the product subject to the contract on the website www.wungen.com, as well as the sales price, payment period, and preliminary information regarding delivery.

1.2. The product subject to the contract shall be delivered to the BUYER or the person/entity designated by the BUYER at the address indicated on the internet site within the period specified on the internet site, depending on the distance of the BUYER’s place of residence, not exceeding four days.

1.3. If the product subject to the contract is to be delivered to a person/entity other than the BUYER, the SELLER shall not be liable for the refusal of delivery by the designated person/entity.

1.4. The SELLER is responsible for delivering the product subject to the contract in sound, complete, and in accordance with the specified qualifications in the order, along with any warranty documents and user manuals if available.

1.5. The delivery of the product is contingent upon the submission of the signed copy of this agreement to the SELLER and the payment being made by the BUYER using the preferred payment method. If the product price is not paid for any reason or is canceled in the bank records, the SELLER shall be deemed relieved of the obligation to deliver.

1.6. In the event of unauthorized use of the BUYER’s credit card by a person other than the BUYER following the delivery of the product, and if the relevant bank or financial institution does not pay the product price to the SELLER due to such unauthorized use, the product shall be returned to the SELLER within three days with the condition of being delivered to the BUYER.

RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from the contract by rejecting the product within four days from the delivery to themselves or to the person/entity at the indicated address. The withdrawal period is four days if the SELLER or Provider fails to comply with the rules specified in the Distance Contracts Regulation. During this period, it is sufficient for the withdrawal notification to be made in writing or through a continuous data carrier.

The product price shall be refunded to the BUYER within four days upon the return of the withdrawal package to the SELLER.

The BUYER undertakes to receive the returned product within four days without any legal or penal liabilities and commits to return the product to the SELLER or provider, acknowledging that the withdrawal package belongs to them.

For returns where the provisions of the 385 Tax Procedure Law General Communiqué are not applied, the relevant sections on the invoice with the return section sent to you must be completed and signed in full, and then the product must be returned by yourself. However, for shipments to Northern Cyprus and abroad, customs duties are collected for VAT payments in their planning. Customers have no right of withdrawal for products not picked up from customs under any circumstances.

Unless otherwise agreed by the parties, the consumer cannot exercise the right of withdrawal in the contracts listed below.

a) Service contracts where performance has begun with the consumer’s consent before the withdrawal period expires,

b) Contracts for the supply of goods whose price is dependent on fluctuations in the financial market that cannot be controlled by the seller,

c) Contracts for the supply of goods that are made according to the consumer’s specifications or are clearly personalized,

d) Contracts for the supply of goods that are liable to deteriorate or expire rapidly,

e) Contracts for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery,

f) Contracts for the supply of goods which are, after delivery, according to their nature, inseparably mixed with other items,

g) Contracts for the supply of alcoholic beverages, the price of which has been agreed upon at the time of the conclusion of the sales contract, the delivery of which can only take place after thirty days, and the actual value of which depends on fluctuations in the market which cannot be controlled by the seller,

h) Contracts for the supply of sealed audio or sealed video recordings or sealed computer software which were unsealed after delivery,

i) Contracts for the supply of a newspaper, periodical, or magazine with the exception of subscription contracts for the supply of such publications,

j) Contracts concluded at a public auction,

k) Contracts for the provision of digital content which is not supplied on a tangible medium if the performance has begun with the consumer’s prior express consent and his acknowledgment that he thereby loses his right of withdrawal.

In case of exercise of the right of withdrawal, product and package control (wungen.com) will be carried out. The shipping cost of the returned product due to the right of withdrawal is covered by the SELLER. The BUYER may submit their requests and complaints to the SELLER in writing or via a continuous data carrier. (For detailed information, please refer to the Distance Contracts Regulation.)

DEFAULT PROVISIONS

In case either party fails to fulfill their obligations arising from this agreement, the provisions regarding Debtor’s Default in Articles 106-108 of the Turkish Code of Obligations will apply. If the obligations are not fulfilled within the specified period without a valid reason, the other party shall give a seven-day notice to the defaulting party for the performance of the obligation. If not fulfilled within this period, the defaulting party shall be considered in default, and the other party shall have the right to demand the performance of the obligation, delivery of the goods, and/or termination of the contract and the refund of the price.

If the SELLER is unable to deliver the product subject to the contract within the specified period due to force majeure events or interruptions in transportation such as adverse weather conditions, transportation interruption, fire, earthquake, flood, etc., the BUYER may cancel the order or postpone the delivery until the obstacle preventing the delivery is eliminated. If the BUYER cancels the order, the amount paid will be refunded within fourteen days. (For installment purchases made with a credit card, the above procedure is accepted by the BUYER for a refund to the credit card.)

COMPETENT COURT

In the implementation of this contract, Consumer Problems Arbitration Boards up to the value announced by the Ministry of Customs and Trade, and Consumer Courts at the place of residence of the BUYER or the SELLER are authorized.

GENERAL RETURN/EXCHANGE CONDITIONS

• Accessories (Necklace, Socks) cannot be returned or exchanged.
• Products that have lost their resalability (washed, sprayed with perfume, label removed) and cannot be purchased by another customer will not be accepted for return.
• Return and exchange transactions must be completed within 14 DAYS from the order date. Otherwise, the return/exchange of the product will not be accepted under any circumstances.
• The BUYER bears the SHIPPING FEE for exchange transactions.
• By placing an order, the BUYER is deemed to have accepted all the terms of this agreement.
