GENERAL PROVISIONS

1.1. The BUYER declares that they have read and understood the basic characteristics of the products which are the subject of the contract, the sales price, payment method, and preliminary information about the delivery on the website www.wungen.com, and has given the necessary confirmation electronically.

1.2. The subject of the contract product shall be delivered to the BUYER or the person/organization at the address indicated by the BUYER within the period specified on the website depending on the distance of the BUYER’s place of residence, provided that it does not exceed the legal fourteen-day period.

1.3. If the subject of the contract product will be delivered to another person/organization other than the BUYER, the SELLER cannot be held responsible if the person/organization to be delivered refuses the delivery.

1.4. The SELLER is responsible for delivering the subject of the contract product intact, complete, in compliance with the specified qualifications in the order, and, if any, with the warranty documents and user manuals.

1.5. It is a condition that the signed copy of this contract is delivered to the SELLER and the payment is made by the BUYER in the form of payment preferred by the BUYER for the delivery of the subject of the contract product. If for any reason the product price is not paid or canceled in the bank records, the SELLER is deemed to have been relieved of the obligation to deliver the product.

1.6. If, after the delivery of the product, the credit card belonging to the BUYER is used by unauthorized persons in a manner not caused by the fault of the BUYER, and if the relevant bank or financial institution does not pay the product price to the SELLER due to unauthorized use, provided that the product is delivered to the BUYER, the product must be sent to the SELLER within three days.

RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from the contract by rejecting the product within fourteen days from the delivery of the product to themselves or to the person/organization at the address indicated by them. If the SELLER or the Provider fails to fulfill their obligations as specified in the twelfth article of the Distance Contracts Regulation, the withdrawal period is fourteen days. It is sufficient for the notification of withdrawal to be made in writing or via a continuous data carrier within this period.

Within fourteen days from the date the notification of withdrawal reaches the SELLER, the product price shall be refunded to the BUYER.

We undertake that the BUYER will receive the product back within fourteen days from the date of receipt of the withdrawal notification, without assuming any legal or criminal liability, and undertakes to return the product upon receipt of the withdrawal notification to the SELLER or provider.

In order for return transactions to be made in accordance with the 385 Tax Procedure Law General Communique, the relevant sections in the invoice with the return section sent to you must be filled in completely and signed, and then the product must be returned to us. However, for shipments to TRNC and abroad, our customers are obliged to pay the taxes of the products they receive at customs since they did not pay VAT in their orders. Customers do not have the right of withdrawal for products not received from customs in any way.

Unless otherwise agreed by the parties, the consumer cannot exercise the right of withdrawal in the following contracts.

a) Service contracts whose performance has begun with the consumer’s consent before the expiry of the withdrawal period,

b) Contracts for goods whose price is determined on the stock exchange or other organized markets,

c) Contracts for the delivery of goods that are prepared according to the consumer’s wishes or clearly for their personal needs, which are not suitable for return due to their nature and which are likely to deteriorate or expire rapidly,

d) Contracts for the delivery of sealed goods that are unsuitable for return due to health and hygiene reasons, if they are unsealed after delivery,

e) Contracts for the delivery of goods which are, after delivery, according to their nature, inseparably mixed with other items,

f) Contracts for the delivery of alcoholic beverages, the price of which has been agreed upon at the time of the conclusion of the sales contract, but which can be delivered at the earliest 30 days after delivery, and whose actual value depends on fluctuations in the market which are beyond the control of the seller or the provider,

g) Contracts for the delivery of periodicals such as newspapers and magazines,

h) Contracts for accommodation, transport of goods, car rental, catering or services related to leisure activities, provided that the contracts provide for a specific date or period of performance,

ı) Contracts concluded at a public auction,

i) Contracts for the provision of digital content that is not supplied on a tangible medium if the performance has begun with the consumer’s prior express consent and his acknowledgment that he thereby loses his right of withdrawal.

In case of the exercise of the right of withdrawal, the product and package control (wungen.com) will be performed. The shipping cost of the product returned due to the right of withdrawal is covered by the SELLER. The BUYER may submit their requests and complaints to the SELLER in writing or via a continuous data carrier. (For detailed information, please refer to the Distance Contracts Regulation.)

DEFAULT PROVISIONS

In case either party fails to fulfill their obligations arising from this agreement, the provisions regarding the Debtor’s Default in Articles 106-108 of the Turkish Code of Obligations will apply. In case of default, if either party does not fulfill their obligations within the specified period without a valid reason, the other party will give a seven-day notice to the defaulting party for the performance of the obligation. If it is not fulfilled within this period, the defaulting party will be considered in default, and the other party will have the right to demand the performance of the obligation, the delivery of the goods, and/or the termination of the contract and the refund of the price.

If the SELLER is unable to deliver the subject of the contract product within the specified period due to force majeure events that may prevent the fulfillment of this obligation or interruptions in transportation such as adverse weather conditions, interruption of transportation, fire, earthquake, flood, etc., the BUYER may cancel the order or postpone the delivery until the obstacle preventing the delivery is eliminated. If the BUYER cancels the order, the amount paid will be refunded within fourteen days. (For installment purchases made with a credit card, the above procedure is accepted by the BUYER for a refund to the credit card.)

COMPETENT COURT

In the implementation of this contract, Consumer Problems Arbitration Boards up to the value announced by the Ministry of Customs and Trade, and Consumer Courts at the place of residence of the BUYER or the SELLER are authorized.

General return/exchange conditions are as follows;

• Accessories (Necklace, Socks) cannot be returned or exchanged.

• Products that have lost their resalability (washed, sprayed with perfume, label removed) and cannot be purchased by another customer will not be accepted for return.

• Return and exchange transactions must be completed within 14 DAYS from the order date. Otherwise, the return/exchange of the product will not be accepted under any circumstances.

• The BUYER bears the SHIPPING FEE for exchange transactions.

By placing an order, the BUYER is deemed to have accepted all the terms of this agreement.
